1) Agreement to Terms
By accessing or using our websites, services, memberships, bookings, or tools (the “Services”), you agree to these Terms & Conditions (“Terms”) and to any policies we link below. If you don’t agree, do not use the Services.
2) Who We Are
“360 Farms & Winery,” “360,” “we,” and “us” refer to our farm, venue, and programs operating in Georgia and Arkansas.
3) Eligibility

You must be 18+ to create an account or buy Services (or the age of majority in your state).

Alcohol experiences require 21+ with a valid government ID. We may refuse service to intoxicated guests.
4) Accounts & Security
You’re responsible for keeping your login confidential and for all activity under your account. Tell us right away if you suspect unauthorized use. We may suspend accounts for misuse or risk to the community.
5) Memberships & Subscriptions
We offer free and paid memberships that unlock digital tools (e.g., AI Mentor, Pest Identifier, Crop Forecaster, alerts).

Auto-renewal: Paid plans renew monthly or annually until canceled.

Manage or cancel: Account → Subscriptions.

Credits: Message/photo/analysis credits reset monthly and do not roll over.

6) Bookings, Classes & Events
Public events (tastings, classes), tours, assessments, workshops, and private rentals follow our booking and event rules, including cancel/reschedule windows and deposits.

7) Orders, Shipping & Title
Unless we state otherwise in writing, the receiver pays all shipping charges (freight collect), including insurance, duties/taxes, and carrier fees. Title and risk transfer FOB Shipping Point when the carrier accepts the shipment.

8) Pricing, Taxes & Payment
Prices, taxes, and fees are shown at checkout or in your plan. We may change prices prospectively. For subscriptions, you authorize us (and our processors) to charge your payment method on a recurring basis until you cancel. Late/failed payments may pause access.
9) Digital Tools & Important Disclaimers
Our tools (e.g., AI Mentor, Pest Identifier, Crop Forecaster, Microclimate Alerts, Voice-to-Journal) use data and machine learning to generate suggestions. Outputs may be incomplete or inaccurate.

Follow all pesticide labels and laws. Label directions control.

Tools do not provide medical, legal, financial, or emergency advice. Use at your own risk.
10) User Content & Community Conduct
You may upload content (photos, notes, listings, reviews). You grant us a non-exclusive license to host, display, and process it to operate the Services. Don’t post unlawful, infringing, harassing, or harmful content. We may remove content or suspend access for violations.
11) Intellectual Property
All site content, logos, software, and materials are owned by 360 or our licensors. You receive a limited, revocable, non-transferable license to use the Services for personal or internal business use while you comply with these Terms. No resale or redistribution without permission.
12) Prohibited Uses
You may not: (a) circumvent paywalls or limits; (b) scrape, mine, or bulk-export without consent; (c) interfere with security or operations; (d) reverse engineer; (e) use automated bots to exhaust credits; (f) infringe others’ rights; or (g) use the Services for unlawful acts.
13) Third-Party Services
Some features rely on third parties (payments, maps, weather, SMS, video). We’re not responsible for third-party outages or errors, but we’ll make reasonable efforts to restore service.
14) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 360 AND ITS OWNERS, STAFF, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE AT ISSUE IN THE 3 MONTHS BEFORE THE CLAIM.
16) Indemnification
You agree to defend, indemnify, and hold harmless 360 from claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your content, your breach of these Terms, or violation of law or third-party rights.
17) Suspension & Termination
We may suspend or terminate access for policy violations, fraud, non-payment, or risk. If we terminate without cause, we’ll refund any unused portion of a prepaid term.
18) Changes to the Services or Terms
We may update the Services or these Terms from time to time. We’ll post the updated Terms with a new “Effective Date.” Continued use means you accept the changes.
19) Communications; SMS
By using the Services you consent to receive transactional emails. For SMS alerts (e.g., microclimate), you must opt in; message/data rates may apply. Text STOP to opt out; HELP for help.
20) Privacy
Your use is subject to our Privacy Policy, which explains how we collect and use information.

21) Governing Law & Venue
These Terms are governed by the laws of the State of Georgia (without regard to conflicts rules). Courts located in Dougherty County, Georgia (or another competent GA court) will have exclusive jurisdiction, unless local law requires otherwise.
22) Severability; Entire Agreement; Assignment
If a provision is invalid or unenforceable, the rest remains in effect. These Terms and linked policies are the entire agreement between you and 360 regarding the Services. You may not assign your rights without our consent; we may assign as part of a merger, sale, or reorganization.

Terms & Conditions - the basics
Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.
T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).
T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.
What to include in the T&C document
